RESPONSE TO TOWER OVERLAY ZONING DISTRICT REQUIREMENTS <br /> <br />(responses in Bold) <br /> <br />900.10 (19.) Antenna Tower Overlay Zoning District <br /> <br />A. Purpose. The purpose of the Antenna Tower Overlay <br />District is to protect the public health, safety, general <br />welfare, and to accommodate the telecommunication needs of <br />residents and businesses by providing a specific zoning <br />district for the use of land for the establishment and <br />operation of wireless telecommunication towers. Since this <br />use is unique, a special zoning district is appropriate, <br />and the City of Elk River reserves the right to determine <br />the suitability of a rezoning request to Antenna Tower <br />Overlay District based on criteria which includes the <br />following: <br /> <br />i. The compatibility of the rezoning request with <br />surrounding land uses <br /> <br />The use will be compatible with the surrounding land uses. The <br />proposed design and location for the tower will be screened as <br />much as possible with existing mature trees. The proposed <br />equipment and lower part of the tower will not be able to be seen <br />from surrounding properties or Highway 169 corridor. Only the <br />upper portion of the tower will be able to be seen above the top of <br />the tree line. The tower will be a monopole design with a <br />galvanized steel finish, which will blend into the sky background. <br /> <br />ii. That the proposed rezoning is necessary in <br />to provide effective wireless telecommunication <br />coverage for the City <br /> <br />order <br /> <br />The proposed tower overlay zone is necessary in order to provide <br />effective wireless telecommunication coverage for the City. There <br />are no tower overlay zoned properties in the search ring area. The <br />closest existing tower is over a mile to the south of this proposal. <br />The existing tower site was tested by our Radio Frequency <br />Engineer and failed to meet radio frequency test requirements. <br /> <br />iii. The rezoning is in accordance with the <br />Comprehensive Plan for the City° <br /> <br />The proposed tower overlay zone is in accordance with the <br />Comprehensive Plan for the City. The proposed tower will <br />provide wireless communications in a location where there is a <br /> <br /> <br />
