In a survey of other <br />communities, Elk River had the smallest rear yard setback of all (see <br />attached survey). Most cities require a rear yard setback between 20 and 30 <br />feet. In our review of past single family building permits, rarely are homes <br />located any where close to the 10 feet rear yard setback. Most meet a <br />minimum of a 30 foot rear yard setback. Attached to your report is a drawing <br />of the minimum size lot allowed in the Rlc zoning district (80' x 125' - 10,000 <br />sq. ft. in size.) The sketch indicates that a 25 foot rear yard setback would <br />not jeopardize the placement of a building or home on the property. In this <br />example, a front yard setback in the Rlc zoning district is 30 feet. Atypical <br />house is approximately 45 feet in width. Therefore, there still is a minimum <br />of 50 feet from the rear of the home to the back property, which is ample <br />room to construct a deck or 3-season porch, etc. and still meet the proposed <br />25 foot rear yard setback. <br />Recommendation <br />Staff recommends the Planning Commission recommend approval of the code <br />amendment as proposed in the attached ordinance. <br />• <br />:7 <br />s:plennin g;pc:oa95-13 <br />
