04/06/10 08:51 PM <br />HOUSE RESEARCH BE/KS H3512DE3 <br />3.t Sec. 3. Minnesota Statutes 2008, section 144.1222, is amended by adding a subdivision <br />3.2 to read: <br />3.3 Subd. 3c. Indoor ice arenas; required equipment. (a) After March 1, 2011, no <br />3.4 indoor ice arena may operate in this state unless all nonelectric ice resurfacing and ice <br />3.s ed in equipment operated in the indoor ice arena is equipped with a properly tuned <br />3.6 three way catalytic converter or an equivalent device that reduces emissions of carbon <br />3.7 monoxide nitrogen oxides and hydrocazbons. <br />3.s (b) After January 1 2013 no indoor ice azena may operate a device powered by an <br />3.9 internal combustion engine other than ice resurfacing or ice edging equipment, less than <br />3.to two hours before a skater is on the ice or spectators aze permitted to enter the indoor ice <br />3.1 t arena unless the indoor ice arena has been issued a permit to operate the equipment by the <br />3.t2 commissioner of health A permit issued under dais paragraph is valid for a time period to <br />3.13 be determined by the commissioner However a permit issued under this section may not <br />3.14 be used to evade an indoor ice arena's responsibility to comply with paragraph (c). An <br />3. is application for a permit issued under this paragraph must be accompanied by a fee of $75. <br />3.16 !c) After January 1 2014 an indoor ice arena operative in this state must: <br />3,i7 (1) use ice resurfacing and ice edging equipment that is exclusively powered by <br />3.18 .electricity; or <br />3.19 (2) contain an operational and properly calibrated electronic air monitoring device <br />3.2o that continuously monitors and records the concentration of carbon monoxide and nitrogen <br />3.2t dioxide in the air inside the ice arena An indoor ice arena may contract with a qualified <br />3.2z entity to properly calibrate and maintain the operation and accuracy of an electronic air <br />3.23 monitoring and recording device. <br />324 (d) By December 1 2013 an undoor ice azena operator must notify the commissioner <br />3.25 of health in writing whether the indoor ice arena has elected to comply with clause (1) or <br />3.26 clause (2) of paragraph (c). <br />3.27 EFFECTIVE DATE. This section is effective the day followinE final enactment. <br />3.28 Sec. 4. Minnesota Statutes 2008, section 240A.09, is amended to read: <br />3.29 240A.09 PLAN DEVELOPMENT; CRITERIA. <br />3.30 The Minnesota Amateur Sports Commission shall develop a plan to promote the <br />3.31 development of proposals for new statewide public ice facilities including proposals for <br />3.32 ice centers and matching grants based on the criteria in this section. <br />Sec. 4. 3 <br />
