The city engineer, city planner, city attorney and I have all <br />had conversations with Gary Santwire (representing REP) regarding this <br />change order. In turn, Gary Santwire has had numerous conversations with <br />the owner of McDonalds in order to get his concurrence with the change <br />order. <br />We are all in agreement that the change order makes sense to minimize <br />construction in this area when a 1996 Dodge Avenue project takes place. It <br />is anticipated that by Monday evening, staff will have received a signed <br />waiver of assessment appeal statement from the benefited property owners <br />which will state the amount, interest rate, and length of the assessments for <br />the four benefited property owners. One hundred percent of the cost of this <br />change order is planned to be assessed out to these individuals per our <br />mutual agreement. <br />Unless something changes between now (Thursday) and Monday's Council <br />meeting, staff recommends approval of the change order and the assessment <br />appeal waiver as presented by the city engineer and city attorney. <br />• <br />5.13. <br />13065 Orono Parkway • P.O.
