6.9 Authorization of Benefit Payments. The Plan Administrator shall issue directions <br />to the Employer concerning all benefits to be paid from the Employer's assets <br />pursuant to the provisions of the Plan, and shall warrant at the time the directions <br />are provided that all such directions are in accordance with the Plan. <br />6.10 Benefit Payments. The Participant shall be reimbursed at least either (a) once per <br />month, or (b) when the total reimbursement for eligible expenses first equals or <br />exceeds a reasonable minimum amount that the Plan Administrator may <br />communicate to Employees from time to time. <br />6.11 Overpayments. If a payment for benefits is made by the Plan in excess of the <br />benefit to which a Covered Individual is entitled under the Plan, the Plan shall have <br />the right to recover such overpayment from the payee. Repayment of an <br />overpayment is a condition of participation in the Plan. <br />6.12 Inability to Locate Payee. If benefits are due under this Plan and the Plan <br />Administrator is unable, after reasonable attempts to do so, to locate the Participant <br />to whom such benefits are payable, such benefits shall be handled in accordance <br />with applicable state law regarding unclaimed property or escheat. For purposes of <br />the foregoing, the Plan Administrator shall be deemed to be unable to locate a <br />Participant if a check issued for benefits payable under the Plan has been sent to the <br />payee's last known address and has not been cashed within three (3) years of its <br />date of issuance. <br />6.13 Facility of Payment. Whenever, in the Plan Administrator's opinion, a person <br />entitled to receive any payment of a benefit or installment under the Plan is under a <br />legal disability or is incapacitated in any way so as to be unable to manage their <br />financial affairs, the Plan Administrator may request the Employer to make payments <br />to such person, or the Plan Administrator may request the Employer to apply the <br />payment for the benefit of such person in such manner as the Plan Administrator <br />considers advisable. Any payment of a benefit, or installment, in accordance with <br />the provisions of this Section, shall be a complete discharge of any liability for the <br />making of such payment under the provisions of the Plan. <br />6.14 Other Powers and Duties of the Administrator. The Plan Administrator shall <br />also have such other duties and powers as may be necessary to discharge its duties <br />under the Plan including, but not limited to, the following: <br />(a) discretion to construe and interpret the Plan in anon-discriminatory manner, <br />to decide all questions of eligibility, except to the extent the eligibility <br />determinations are governed by an insurance contract, and to determine all <br />questions arising in the administration and application of the Plan, except to <br />the extent such eligibility determinations are governed by an insurance <br />contract; <br />(b) to receive from the Employer and from Participants such information as shall <br />be necessary for the proper administration of the Plan; <br />(c) to furnish the Employer, upon request, such annual reports with respect to <br />the administration of the Plan as are reasonable and appropriate; and <br />(d) to appoint individuals to assist in the administration of the Plan and any other <br />agents the Plan Administrator deems advisable, including legal and actuarial <br />20 <br />
