This arrangement is a negotiated procurement. While any final design completed on the railroad <br />infrastructure would be procured under a best value procurement, the construction of the <br />infrastructure improvements themselves will be performed by the BNSF directly as the current <br />and ultimate owner of any of the capital improvements made. <br /> <br />BNSF will also procure its own materials for use in the capital improvement construction. Such <br />procurements must be made in compliance with both state and federal statutes, rules, regulations, <br />and policies. BNSF's current materials acquisition process is highly competitive and <br />substantially in compliance with the pertinent state and federal guidelines. <br /> <br />5.1.2 Multi-Modal Connection <br /> <br />Construction of the multi-modal connection between the Hiawatha Corridor and the Northstar <br />Corridor is to be accomplished through a conventional IFB process. Certain track and systems <br />elements with long lead times for fabrication and delivery, such as special trackwork and the <br />additional traction power substation, may be procured through the desigu-build contract currently <br />underway for the Hiawatha Corridor. Mn/DOT would negotiate through Metro Transit for a <br />contract amendment to procure the materials only. The construction contractor for the multi- <br />modal connection would then be responsible for incorporating the installation and testing of <br />those items furnished by Mn/DOT. If acquisition of certain track and systems elements in not <br />feasible through the current Hiawatha I JRT Project design-build contractor, it will be the <br />responsibility of the contractor for the multi-modal connection to provide all materials necessary <br />to accomplish this portion of the Northstar Corridor Rail Project. <br /> <br />5.1.3 Rolling Stock <br /> <br />Locomotives may be procured once performance specifications are completed by Mn/DOT for <br />the desired vehicles. The specifications become the contract documents for competitive bidding, <br />and the contract is negotiated and awarded to the most qualified manufacturer with the lowest <br />responsible cost proposal for a product(s) that meets all the stipulated performance requirements. <br /> <br />Coaches may be procured in the same manner as locomotives or may be procured though an IFB <br />once complete specifications are produced by Mn/DOT. <br /> <br />5.1.4 Stations and Maintenance Facility <br /> <br />The stations and the maintenance/layover facility for the Northstar Corridor Rail Project may be <br />included under one contract package or constructed separately. In either case, it is recommended <br />that Mn/DOT prepares the final design plans and specifications for both the stations and <br />maintenance facility, and advertises the work under a conventional IFB process. <br /> <br />Specific in-place maintenance equipment may be procured with performance specifications under <br />individual or collective competitive bidding or sole-sourcing.
