Box 490 <br />Elk River, MN 55330-0490 <br /> <br />RE: MnDOT MULTI-MODAL LOT <br /> <br />Dear Council Members: <br /> <br />In conjunction with the construction of the multi-modal lot located along the railroad <br />tracks between Tyler Street and the 173rd Avenue right-of-way, MnDOT would like to <br />acquire an easement from the City of Elk River, as shown on the attached exhibit. The <br />easement is located north of the 173rd Avenue right-of-way and is for the purposes of <br />discharging stormwater from the pond located on their site to the ditch located in the <br />property the City acquired from the Browns. MnDOT has offered $6,836 for the right to <br />this easement. <br /> <br />The Memorandum of Understanding prepared by MnDOT states that the City may use <br />the easement for wetland mitigation. Wetland mitigation is something the City will have <br />to undertake when they develop the Brown property for business park development <br />sometime in the future. <br /> <br />Also attached to this letter are an Offer to Sell and Memorandum of Conditions and a <br />Highway Easement both prepared by MnDOT. We would recommend that the City <br />Council authorize the Mayor and City Clerk to execute these agreements. <br /> <br />If you have any questions regarding this issue, I will be in attendance at your May 21, <br />2001, City Council meeting. <br /> <br />Sincerely, <br /> <br />Howard R.
