Memorandum of Understanding <br />Page 2 <br /> 5. <br /> <br />o <br /> <br />R/W purchased for the outlet of the storm drainage pond will not prohibit the <br />City from developing the Wetland Mitigation site that is being proposed in <br />this area. <br /> <br />The northwesterly intersection with Tyler Street developed under Phase II of <br />the Park and Ride facility will be maintained as the desired access onto Tyler <br />Street. R/W being purchased by Mn/DOT will prohibit access to the north, <br />eliminating a full access intersection from being constructed at the present <br />location. <br /> <br />During construction, Tyler Street will remain open to traffic at all times. <br /> <br />Coordination with the City's contractor working on Tyler Street will be <br />maintained so that outstanding issues are resolved. The City's contractor will <br />be invited to a Pre-Construction meeting prior to construction. The <br />outstanding items under the City's contract shall be discussed at the pre- <br />construction meeting. <br /> <br />Maintenance of the Park and Ride facility will be the responsibility of <br />Mn/DOT either through the use of a separate maintenance agreement with a <br />vendor or future arrangements made with some other entity (i.e. City or <br />Commuter Rail operator) <br /> <br />I concur with this Memorandum of Understanding. <br /> <br />MINNESOTA DEPARTMENT <br />OF TRANSPORTATION <br /> <br />CITY OF ELK RIVER <br /> <br />Richard A.
