NORTHSTAR CORRIDOR DEVELOPMENT AUTHORITY RESOLUTION 2001- AUTHORIZING TERMINATION OF AGREEMENT FOR COORDINATION OF COMMUTER RAIL ACTIVITIES, MN/DOT AGREEMENT NO. 80272-R WHEREAS, on October 2, 2000, the Northstar Corridor Development Authority ("NCDA") and the Minnesota Department of Transportation ("Mn/DOT") entered into an Agreement for Coordination of Commuter Rail Activities, Mn/DOT Agreement No. 80272-R (the "Agreement"), for the purpose of coordinating the activities of the parties in the development of commuter rail in the Northstar Corridor; and WHEREAS, the Agreement delegated to the NCDA certain duties of Mn/DOT with respect to development of the Northstar Commuter Rail Project; and WHEREAS, the Commissioner of Mn/DOT has indicated his desire to conduct the next phase of project development; and WHEREAS, the Agreement must be terminated in order to accomplish the transition of the Northstar Commuter Rail Project to Mn/DOT; and WHEREAS, the Agreement provides that NCDA may terminate its participation in the Agreement by giving 60 days written notice to Mn/DOT. NOW, THEREFORE BE IT RESOLVED that the Northstar Corridor Development Authority hereby gives notice to Mn/DOT that it is terminating the Agreement for Coordination of Commuter Rail Activities, Mn/DOT Agreement No. 80272-R, effective 60 days after written notice to Mn/DOT. BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the Director of the Mn/DOT Office of Passenger Rail, Mn/DOT's authorized agent to receive notices under the Agreement.
