Memo to the Mayor and City Council <br />November 18, 1996 <br /> <br />Page 2 <br /> <br />presented to the City Council it was denied in a large part because of <br />arguments made by a prospective developer of Waddy Schultz's property. <br /> <br />During the course of the Council's dehberation, there was some discussion <br />that there should be some consideration given to rezoning the properties <br />owned by Industrial Hardfacing and George Deschenes. It was noted that the <br />possible realignment of County Roads 12 and 13 would better define an <br />industrial area and that these properties would hkely be within the <br />boundaries of any future industrial zone. In hght of this discussion, the <br />Council directed staff to look into the possibility of rezoning the Industrial <br />Hard/acing and Deschenes properties. <br /> <br />Existing[ Conditions <br /> <br />The area under consideration for rezoning is approximately 13 acres in area. <br />Current uses are Industrial Hard/acing hght manufacturing facility, a single <br />family home and undeveloped land. There are 2 small wetlands and the <br />vegetation is a mix of hardwoods, brush and volunteer growth. <br /> <br />The surrounding properties are zoned Rlc with a land use designation of <br />light industrial to the south and medium residential to the east, west and <br />north. The properties are within the urban service area. <br /> <br />Evaluation of Request <br /> <br />In order to approve a rezoning request there must be a finding that a) the <br />plan was in error when it was adopted, and therefore, should be changed or, <br />b) the times and circumstances have changed since the plan was adopted, <br />and a change is warranted. <br /> <br />This rezoning is being considered in order that this area will be consistent <br />with the land use plan. The updated land use plan designated this area as LI <br />(Light Industrial). The proposed rezoning to I1 (hght Industrial) is <br />consistent with that revised land use designation, and therefore, the second <br />finding is met. <br /> <br />Consideration should also be given to the existing conditions within the area <br />directly and indirectly affected by the proposal, the use to which the property <br />affected is being devoted at the time and the relevant portions of the land use <br />plan. The Industrial Hardfacing property is currently being utilized in a way <br />that is consistent with hght industrial zoning. <br /> <br />The rezoning is consistent with the concept of providing industrial land <br />within the urban service area and the ease that municipal services could be <br /> <br />s:\planning\scott\zc9618cc.doc <br /> <br /> <br />
