2009} outlining design modifications to the expansion proposal, the end use plan for the landfill, and other issues; and ~JHEREAS, City Staff and City consultants reviewed the revised plans, the Voith Report, the September S, 2009 letter and all other materials submitted by ERL, and prepared a staff report which was deli~rered to the City Council and Punning Commission, along with all of the materials submitted by ERL, on September S, 2009; and ~IHEREAS, the City Council and Planning Commission met in point worl~shop session on September i 4, 2009 to discuss the materials submitted by ERL, including the revisions to the expansion proposal for the Landf~]l; and WHEREAS, ERL was provided an opportunity to present its reprised plans and proposed design modifications for the expansion to the City Council and the Planning Coinn~ission at the September 14, 2009 worl~shop session and the City Council had the opport~xnity to discuss and asl~ questions regarding the revised proposal; and ~IHEREAS, on September 21, 2009 the Ells Ri~rer City Council held a public hearing on the Application and provided ERL, wMI and Tiller, as well as all members of the public desiring to do so, the opportunity to present additional testimony and comment on the Application, as revised, and to submit additional written evidence; and WHEREAS, after all parties desh.~ing to present testimony and offer evidence for or against tl~e Application had had the opportunity to do so, the Ells River City Council. closed the public hearing on the Application, continued its discussion of the Application, and reached tlae decision incorporated in this resolution; and WHEREAS, ERL has agreed in writing to an extension of the City's tune deadline for acting on the application under Minnesota Statutes, Section 15.99 to September 2C, 2009.
