~iIHEREAS, on August 17, 2009, the Ells River City Council continued with tl~.e public hewing on the Application and provided ERL, w'M7 and Tiller, as well as all members of the public desiring to do so, the opportunity to present additional testimony and written evidence to the City Council; and ~IHEREAS, after all parties denting to present testimony and offer evidence fof of against tl.~e Application laad had the opportunity to do so, the Ells Rives City Council closed t1.~e public hewing on the Application and continued its discussion of the Application; and ~IHEREAS, by letter dated July 15, 2009, and at the August 17, 2009 City Council healing, ERL requested an opportunity to present additional materials and a revised plan to the City Council in a wo~•kslaop session; and WHEREAS, at the close of its session on August 17, 2009, the Ells River City Council directed: ® That any additional mate~•ials be submitted so that a staff repoxt could be distributed to the Cite Council on September S, 2009; ® That the Application be placed on tlae City Council's regular woil~sllop agenda for September 14, 2009; ® That the September 14, 2009 workshop session regarding tl~.e landfill be a joint meeting with the City of Ells Rives Planning Commission; and That the Application be scheduled for another public healing at the Cit~T Council's Legularly scheduled meeting of September 2i, 2009; and ~1HEREAS, representatives of ERL and City Staff met on August 25, 2009 and September 8, 2009 to review additional materials sub~l~itted by ERL regarding tlae Application, including a revised plan for the landfill expansion, a report entitled "~s Landfill Expansion a Good ~n~rest1ne11t for Ells River" the "~oith Report"~ and a letter dated September ~, 2009 revised Septembe~• 8, S:~RcSOlutions~ReSOllt~)11_D~1~~rit~~Applicatio~l_fot_Comp~PIan_Amend~and l~c~at~ing ?,L7QC
