c. The employee refuses the Utilities order to perform an action that the <br />employee has an objective basis in fact to believe violates any State or <br />Federal law or rule regulation adopted pursuant to law and the <br />employee informs the Utility that the order is being refused for that <br />reason. <br />d. No city official or law enforcement official will disclose, or cause to <br />disclose the identity of any employee making a report or providing <br />information under this section without the employee's consent unless <br />the investigator determines that disclosure is necessary for <br />prosecution, the employee will be informed prior to the disclosure. <br />e. Employees shall not ,make any statements or discloser es pursuant to the <br />this section knowing that they are false or that they are in reckless <br />disregard of the truth. <br />f. This section does not permit disclosures that would violate federal <br />or state law or diminish or impair the right of any person to the <br />continued protection of confidentiality or communications provided <br />by common law. <br />6. WORKING HOURS <br />A regular work week shall be five (5), eight (8) hour days. This will constitute a forty <br />(40) hour work week. Non-exempt employees are paid on the basis of hours worked. <br />Exempt employees are paid on a salary basis; their compensation is not based on the <br />number of hours they work. <br />7. OVERTIME <br />Time and one-half will be paid to all employees who work in excess of their regularly <br />scheduled forty (40) hour work week, or eight (8) hour day. Double-time will be paid for <br />all work performed on Sundays or Holidays. Certain supervisory employees are exempt <br />from the overtime provisions. These employees do not receive overtime compensation, <br />but have more flexible work schedules. <br />8. CALL OUT TIME <br />Employees who are asked to report for work outside their regular working hours shall be <br />paid a minimum of two (2) hours each time they report for work. If an employee reports <br />for work before or remains after the regular eight (8) hour work day, or works on a <br />Saturday, Sunday or Holiday, he/she will be paid at the applicable overtime rate. <br />Scheduled work contiguous to normal working hours shall not be subject to a two (2) <br />hour minimum overtime obligation. <br />9. ON-CALL <br />Certain regular field workers are required to be on call for one (1) week periods on a <br />rotation basis. Compensation is eight (8) hours of overtime pay.
