Memo to the Mayor and City Council/CU96-23 Page 3 <br />October 21, 1996 <br /> <br />property or the adjacent properties and would not be incompatible with the <br />surrounding land uses. <br /> <br />Conditional Use Permit <br /> <br />Section 900.12.19 of the Ordinance outlines performance standards applicable to <br />antenna towers. The proposal was compared to these standards and was found <br />to be in compliance with them. <br /> <br />One of the main concerns with these towers is the possibility that the tower will <br />collapse on adjacent properties. The manufacturer of the pole has indicated in a <br />letter that the pole is engineered to collapse on itself, not fall over like a tree and <br />land on the neighboring lot. Because the proposed height of the tower does not <br />exceed 200 feet, the applicant is not required to file for F.A.A. authorization. The <br />pole doe not encroach into any setback, fight-of-way, property line or sidewalk. <br />The pole will also designed to exceed the wind loading factor of the Unified <br />Building Code and will meet all electrical requirements. To discourage climbing <br />there will be no climbing apparatus within 12 feet of the ground and the <br />applicant has agreed to construct a fence around the facility. <br /> <br />The applicant has stated that they have not received any report of television or <br />radio interference nation wide. The applicant contacted the St. Paul office of the <br />F.A.A. and their office had not received any complaints of interference caused by <br />cellular phones. <br /> <br />The zoning code states that multiple principle structures on a single lot require <br />a conditional use permit. Since this pole is considered a principle structure, any <br />further development of this property will require a conditional use. This will <br />allow the city an opportunity to insure that the antenna pole and access to it is <br />integrated into future development of the property. <br /> <br />Planning Commission Meeting <br /> <br />At the Planning Commission meeting held on September 24, 1996 the <br />neighboring property owner to the north, Mr. Majkrzak, spoke against the <br />antenna tower. He voiced concern about the antennas impact on satellite <br />reception and how the tower would impact his property values. The applicant <br />addressed his concern regarding the impact on satellite reception; the applicant <br />indicated that it was the long range microwave antennas, not cellular <br />transmissions, that affect satelhte dish reception. <br /> <br />Recommendation <br /> <br />The Planning Commission and staff recommend that the City Council approve <br />the rezoning request to Antenna Tower overlay District based on the following: <br /> <br />s:\planning\scott\cu9623cc.do c <br /> <br /> <br />
