Case File: CU 06-18 Page 3 Standards for Issuance of a Conditional Use Permit (Section 30-654 The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1-Ylill not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience orgeneral welfare of the neighborhood or the ~y. A restaurant establishment is not an uncommon service use in a commercial location. The proposal does not appear to negatively impact the neighborhood or the city. 2. 1,Vill be consistent avith the comprehensive plan. The Comprehensive Plan guides the existing use as Light Industrial. The City may wish to consider a change in the Comprehensive plan in the future. 3. 1-Y>ill not impede the normal and orderly development and improvement of surrounding vacant propery Other than to the south, there is no surrounding vacant property. The establishment would be consistent with other businesses providing services to the neighborhood. 4. I~Vill be served adequately by and will not adversely affect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and server systems, parks and schools; and will not, in particular, create tra~c congestion or interference with tra~c on adjacent and neighboring public thoroughfares. Conditions limiting the peak p.m. traffic were created during the platting process. This request falls within those limits. 5. lY>ill not involve uses, activities, processes, materials, equipment and conditions of operation that aarill be detrimental to any persons orproperty because of excessive tra~c, noise, smoke, fumes, glare, odors, dust or vibrations. There is not expected to be any excessive impact on adjacent properties. 6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance. There will not be any loss or damage of natural, scenic or historic features. 7. lYlill fully comply with all other requirements of this Code, including any applicable requirements and standards for the issuance of a license orpermit to establish and operate the proposed use in the city. It is expected that the applicant will comply with all other requirements. If denial of such a permit should occur, it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654.
