Box 430 <br />Elk River, MN 55330-0430 <br />October 4, 2007 <br />To: Elk River Municipal Utilities Commission <br />Jerry Takle <br />Jerry Gumphrey <br />Jim Tralle <br />From: Bryan Adams <br />Subject: Miscellaneous Issues <br />Phone: 763.441.2020 <br />Fax: 763.441.8099 <br />Enclosed is the packet for Tuesday, October 9, 2007 commission meeting at 4:00 p.m. <br />We have had a number of discussions this last year concerning ISD 728 use of irrigation wells. <br />This issue has been successfully resolved with the execution of an agreement letter dated <br />September 12, 2007 which is attached. <br />At our September Elk River Municipal Utilities Commission meeting we discussed renewable <br />energy and the changed requirement due to the recent legislation revising "best efforts" to <br />"shall". Attached is the letter that was sent to our affected customers. We have received fewer <br />than 10 calls about this issue with only 2 people cancelling their participation. <br />As you may recall, we have been involved in a wrongful death lawsuit as a result of a young <br />driver losing control of the vehicle and striking a utility pole (Lorenz case). League of <br />Minnesota Cities has been representing us. This case was recently dismissed for lack of <br />evidence showing us negligent. <br />As a final note, attached are two articles from the September 16, 2007 Star Tribune titled <br />"Battling Tainted Water" and "The Pollution that Lies Beneath". Both are good articles worthy <br />of your time. <br />
