Elk River City Council Meeting <br />February 26, 1996 <br /> <br />Page 5 <br /> <br />5.2 <br /> <br />5.3 <br /> <br /> Consider Wetland Miti.qation Plan for Dan Bowman (Rid.qewood Hills) <br /> <br /> City Engineer Terry Maurer reviewed the memo which was written by Building <br /> and Zoning Administrator Steve Rohlf. <br /> <br /> COUNCILMEMBER DIETZ MOVED TO APPROVE THE WETLAND MITIGATION PLAN FOR <br /> DAN BOWMAN WITH THE FOLLOWING CONDITIONS: <br /> <br />1. THAT THIS APPROVAL IS SUBJECT TO OBTAINING THE NECESSARY PERMIT <br /> FROM THE ARMY CORPS OF ENGINEERS. <br /> <br />2. THAT THE LETTER OF CREDIT FOR THE IMPROVEMENTS IN THE PLAT ALSO <br /> COVERS THE COST OF THE REPLACEMENT WETLANDS FOR ONE YEAR AFTER <br /> THE CITY APPROVES THEIR CONSTRUCTION AND THAT THE DEVELOPER <br /> AGREEMENT REFLECTS THIS. <br /> <br />3. THAT THE REPLACEMENT WETLANDS ARE PROTECTED BY HAVING A <br /> RESTRICTIVE COVENANT RECORDED. <br /> <br />4. THAT THE BOTTOM OF THE CULVERT FOR THE PROPOSED ROAD IN THE <br /> LOCATION OF FORMER JUDICIAL DITCH #1 IS AT THE APPROXIMATE LEVEL <br /> OF THE EXISTING WETLANDS SO THEY ARE NOT DRAINED. <br /> <br />5. THAT THE SLOPES OF THE REPLACEMENT WETLANDS ARE A MAXIMUM TO 4 <br /> TO 1 FOR SAFETY AND NO MATERIALS EXCAVATED FROM ANY WETLAND <br /> CAN BE PLACED BACK INTO A WETLAND. <br /> <br />6. THAT THE DEVELOPER PROVIDES THE CITY WITH A STATUS REPORT ON THE <br /> REPLACEMENT WETLANDS ONE YEAR AFTER THEY ARE CREATED. <br /> <br />COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />Dan Bowman Request for Preliminary Plat Approval (Rid.qewood Hills), Public <br />Hearin.q Case No. P 95-9 <br /> <br />City Planner Steve Ach reviewed his memo to the Council regarding the . <br />preliminary plat for Dan Bowman. <br /> <br />Vice Mayor Holmgren opened the public hearing. <br /> <br />Madelyn Moose, 10246 221st Avenue expressed her concern regarding her trees <br />and fence along her property. <br /> <br />Dan Bowman stated it did not matter whose trees they were, he will not destroy <br />the trees. <br /> <br />There being no further comments from the public, Vice Mayor Holmgren closed <br />the public hearing. <br /> <br />Dan Bowman expressed his concerns regarding three issues: <br />1. Extending the road to the west property line. <br /> <br /> <br />
