The council should also note that it is committing the use of city <br />property for fair parking for the next five years during the County <br />Fair. This may prohibit any other use of this property in the short <br />term. <br />2. Transportation <br />The city engineer, county engineer, mayor, and County Commissioner, <br />Arne Engstrom, should be able to present the transportation topics. <br />Mr. Duitsman and Mr. Engstrom are both on the city Comprehensive <br />Plan Committee that has been talking about long range transportation <br />plans. The city engineer and county engineer have also been talking <br />about these long range plans as well as some of the details related to <br />the proposed County Road 1 project. <br />3. County Ditches <br />Attached for your review is the proposed legislation that would allow <br />the city and county to work together to convey county ditches to the <br />city. Also attached is an update on the status of this legislation from <br />the city attorney. <br />One ditch that has been discussed recently is Ditch 10 and the city's <br />petition to release water into this ditch along Main Street and along <br />County Road 12. The county has recently approved the release of <br />water into this ditch provided that the city maintain the system from <br />the release point to the river. Both projects are moving forward. <br />I believe that there will be some comments on the status of the county <br />ditch the underneath Troy Street. This is part of Ditch 28. At this <br />time, it is desirable from the city's point of view, to have the county <br />install a permanent long-term improvement to this ditch in 1995. If <br />the state legislation has not been approved or signed into law at the <br />time of this work, then the city would request that the expenses that <br />would be assessed against Elk River properties be charged to the city. <br />The benefit that goes to property owners outside of the city's corporate <br />limits should appropriately be assessed out to these benefited <br />properties. The city needs a permanent long-term solution to the Troy <br />Street situation as soon as possible in 1995. Please note that the city <br />would need to review the work plan and cost estimates before agreeing <br />to pay the assessment for all of the Elk River properties. <br />• <br />
