CONTRACT NO. <br />SP 71-596-04 CP 71-640-02 <br />CONTRACTOR NAME ADDRESS CITY STATE ZIP <br />Dresel Contracting 24044 July Avenue Chisago City MN 55013 <br />LOCATION OF WORK: TOTAL SUPPLEMENTAL AGREEMENT AMOUNT <br />CR 40 from CSAH 12 to CSAH 13 (City of Elk River) $336,381.59 <br />This Contract is between the Local Government Entity and Contractor as follows: <br />Whereas: This contract provides, among other things, for the Grading, Aggregate Base, Concrete Curb & <br />Gutter, Storm Sewer, Bike Path, and Bituminous Surfacing on County Highway (CH) 40 between County <br />State Aid highway (CSAH) 12 to CSAH 13; and <br />Whereas: The contract documents required the contractor to place a surcharge on a portion of the road <br />to consolidate the poor soils; and <br />Whereas: The poor soils did not reach consolidation during the 2007 construction season as indicated in <br />the contract documents and will need to be in-place through the 2008 construction season to continue the <br />consolidation of poor soils; and <br />Whereas: The continuation of the surcharge requires the contractor to perform the remaining work <br />beyond the 2007 contract completion date as stated in the contract documents; and <br />Whereas: The contractor has requested an adjustment to the unit prices for the remaining work which <br />includes, removing surcharge material, directional drilling of water main, furnish and install class 5 <br />aggregate base, and pave the remaining portion of the road; and <br />Whereas: The contractor placed additional select granular borrow on the surcharge during the month of <br />June, 2008 to continue the consolidation of poor soils; and <br />Whereas: The contractor has requested additional payment for the placement of select granular material <br />on the surcharge after receiving payment at contract unit bid price in pay request #12; and <br />Whereas: The contractor requests a mobilization payment for the placement of select granular borrow <br />and for finishing all remaining work. <br />NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AND UNDERSTOOD THAT: <br />1) The contractor has agreed to perform all the remaining work in accordance with the Plans and <br />Specifications of the original contract and all work shall meet the requirements of the MN/DOT <br />specifications. <br />2) The contractor agrees to perform the remaining work at the adjusted unit prices as shown in this <br />supplemental agreement. The unit price for each item shall include all materials, .labor and <br />equipment necessary to complete the work. <br />3) The contractor will not make claim of any kind whatsoever for any other expenses which he may have <br />incurred or which he hereafter incurs, in performing the work and furnishing the materials required by <br />this agreement <br />
