Category B trees shall be no less than the following sizes: <br />Deciduous trees, not less than 2% inches in diameter. <br />Coniferous trees, not less than six feet in height. <br /> <br />Category C trees shall be no less than the following sizes: <br />Deciduous trees, not less than 1% inches in diameter. <br />Coniferous trees, not less than four feet in height. <br /> <br />Species requirement. Where ten or more replacement trees are <br />required, not more than 50 percent of the replacement trees shall be of <br />the same species of tree without the approval of the city. <br /> <br />Warranty requirement. Any replacement tree which is not alive or <br />healthy, as determined by the city, or which subsequently dies due to <br />construction activity or lack of watering within one year after the date of <br />project closure shall be removed by the applicant and replaced with a <br />new healthy tree meeting the same minimum size requirements within <br />eight months of removal. <br /> <br />Replacement and location. Trees subject to replacement pursuant to <br />this section shall be in addition to landscape requirements by City Code. <br />Replacement trees shall be planted in one or more of the following areas <br />on land: Restoration areas including slopes, out-lots or common areas, <br />buffer zones between different land uses and/or activities, project <br />entrance areas, and public areas. <br /> <br />Replacement trees shall be of a species similar to the trees which are lost or <br />removed and shall include those species referred by the Minnesota <br />Department of Natural Resources Native Tree Species List. <br /> <br />Subd. 17. Technical Review Committee. If the applicant and the city staff are unable to <br />reach agreement with respect to the interpretation or enforcement of this Section, the <br />matter will be referred to a Technical Review Committee. The Committee will consist of <br />the applicant or a representative of the applicant, a city staff member, and a representative <br />of the forestry division of the Minnesota Department of Natural Resources. The <br />Committee's resolution of the matter shall be final, unless appealed to the City Council by <br />either the applicant or the city staff. <br /> <br />1. When disagreements occur, the City shall have up to 15 days to <br /> arrange a TRC committee meeting. <br /> <br /> <br />
