Terry Maurer noted that if sidewalks <br />are provided along all of the streets in the development, they will hove an <br />impacl on the grading of the lots and a potential for additional tree loss. It was <br />the consensus of the Council to approve Exhibit C as the sidewalk design for the <br />subdivision. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE PRELIMINARY PLAT OF <br />WINDSOR DEVELOPMENT TO SUBDIVIDE APPROXIMATELY 120 ACRES INTO SINGLE <br />FAMILY LOTS WITH THE INCLUSION OF CONDITIONS RELATING TO PARK <br />DEDICATION AND SECURITY ON THE NORTHERN EDGE OF THE PROPERTY TO BE <br />DETERMINED PRIOR TO FINAL PLAT AND BASED ON THE FOLLOWING CONDITIONS: <br /> <br />o <br /> <br />A DEVELOPMENT AGREEMENT BE PREPARED OUTLINING THE TERMS AND <br />CONDITIONS FOR PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS. <br /> <br />COMMENTS OUTLINED IN THE CITY ENGINEER'S MEMO DATED MAY 17, 1 <br />BE ADDRESSED AND INCORPORATED INTO FINAL PLANS FOR THE <br />DEVELOPMENT. <br /> <br />EXCLUDING THE REFERENCE MADE TO SIDEWALKS THROUGHOUT THE <br />DEVELOPMENT, THE PARK AND RECREATION COMMISSION <br />RECOMMENDATION OF MAY 10, 1 ??5 BE INCORPORATED INTO THE <br />DEVELOPMENT. <br /> <br />A WATER AVAILABILITY CHARGE IN THE AMOUNT OF $300 PER LOT BE PAID <br />TO ELK RIVER UTILITIES. DEVELOPER SHOULD CHECK WITH ELK RIVER UTILITIES <br />FOR ANY ADDITIONAL CHARGES RELATIVE TO WATER CONNECTION FEES. <br /> <br />A SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE <br />CITY AT THE TIME OF FINAL PLA'Fi'lNG BE PAID PRIOR TO RECORDING THE <br />P LAT. <br /> <br />ALL OF THE APPROPRIATE PERMITS TO FILL AND MITIGATE WETLANDS BE <br />APPROVED PRIOR TO FINAL PLAT APPROVAL.
