City Council Minutes Page 5 <br />March 12, 2001 <br /> <br />Councilmember Kuester questioned how this motion would affect the public <br />hearing and the changes made to the preliminary plat by the developer. <br /> <br />Mayor Klinzing stated that if the denial resolution is not passed then the Council <br />has the issue before them of looking af the original preliminary plat, which was <br />previously denied. <br /> <br />Councilmember Kuester stated that there should be an item in the motion that <br />states Council would be willing to look at the revised preliminary plat, otherwise <br />why would they reconsider the originally denied plat. <br /> <br />Mayor Klinzing stated that Councilmember Tveite just made a motion to <br />reconsider the original preliminary plat denial. Mayor Klinzing stated that the <br />motion on the table now is the revote on the denial of the originally proposed <br />preliminary plat. <br /> <br />Councilmember Motin stated that he would like to hear comments from the <br />public. <br /> <br />COUNCILMEMBER KUESTER MOVED TO TABLE THE DENIAL OF THE RECONSIDERATION <br />OF THE PRELIMINARY PLAT. <br /> <br />Councilmember Dietz questioned the purpose of tabling this issue. <br />Councilmember Kuester stated that there is no use in looking at the originally <br />denied plat and that Council should look at the revised plat. <br /> <br />City Attorney Peter Beck stated that the City Council adopted a resolution to <br />deny the plat and then made a motion to reconsider the resolution. This motion is <br />on the table and could be voted up or down. After hearing testimony on the <br />issue, Council can decide to reverse the adoption of the denial resolution, <br />reaffirm the adoption of that resolution, or make a motion to approve the plat on <br />condition that certain revisions are made. <br /> <br />COUNCILMEMBER KUESTER WITHDREW HER MOTION. <br /> <br />Senior Planner Scott Harlicker stated that the developer Phoenix Enterprises has <br />made some revisions to the preliminary plat that was brought before Council on <br />January 16, 2001. Mr. Harlicker discussed the revisions that were made which <br />included a reduction in the number of lots from 104 to 99, shifting of Dadge Street <br />to the east, increased in the lot depths of the lots behind Menards from 150 feet <br />to 174 feet thereby creating a larger, usable rear yard, and an increase in <br />average lot size from 16,812 square feet to 17,532 square feet. <br /> <br />Mayor Klinzing asked for public comments on the revisions. <br /> <br />Mike Jenson, 19395 Dodge Street - Gave a history of issues regarding Hillside <br />development. Mr..Jenson discussed traffic flow, park location, tree removal, and <br />retaining walls and felt the new changes in the preliminary plat do not address <br />these issues. <br /> <br /> <br />
