<br />Memo to Mayor and City Council/P 02-18 <br />September 16, 2002 <br />Page 5 <br /> <br />The owner of the 2.5 acre exception on the west side of the project talked about possibly <br />being included in the plat. <br /> <br />The Planning Commission discussed the length of the dead-end and the architectural theme. <br />The Commission was split regarding the length of the dead-end and whether it should be <br />considered temporary. Two commissioners were against it and 3 commissioners were ok <br />with it. They also felt that the applicant should provide additional specific information <br />identifying architectural styles. <br /> <br />The location of the proposed baseball field was also discussed. The Commissioners were <br />concerned about the proximity to the railroad tracks. They wanted the baseball field located <br />north of 19yd Avenue. One commissioner was felt that the field could be located south of <br />193rd if a fence was installed in the outfield along the railroad tracks. <br /> <br />The Planning Commission recommended approval of the preliminary plat by a 3:2 vote with <br />the additional condition that the ballfield/play area be located north of 193rd Avenue. <br /> <br />Recommendation <br /> <br />The Planning Commission recommended that the City Council approve the preliminary plat <br />request for Windsor Oaks with the following conditions: <br /> <br />1. A DEVELOPERS AGREEMENT OUTliNING THE TERMS AND CONDITIONS OF <br />THE PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS BE PREPARED <br />AND EXECUTED PRIOR TO RELEASING THE PLAT FOR RECORDING. <br /> <br />2. ALL COMMENTS OF THE CITY ENGINEER BE SHALL BE ADDRESSED. <br /> <br />3. A HOMEOWNERS ASSOCIATION DOCUMENT BE PREPARED SUBJECT TO THE <br />CITY AlTORNEY'S REVIEW AND APPROVAL PRIOR TO FINAL PLAT. <br /> <br />4. STREET liGHTS BE INSTALLED AS REQUIRED BY ELK RIVER UTIliTIES <br /> <br />5. A LEITER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT OF 100% <br />OF THE COSTS OF THE PUBliC IMPROVEMENTS. <br /> <br />6. UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING THEM <br />ACCEPTED BY THE CITY, A W ARRANfY BOND IN THE AMOUNT OF 25% OF THE <br />IMPROVEMENT COSTS SHALL BE SUBMIlTED TO THE CITY FOR THE PERIOD <br />OF ONE YEAR. <br /> <br />7. SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE <br />CITY AT THE TIME OF FINAL PLAT BE PAID PRIOR TO RELEASING THE PLAT <br />FOR RECORDING. <br /> <br />8. A SEALCOAT FEE IN THE AMOUNT TO BE DETERMINED BY THE CITY <br />ENGINEER BE PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. <br /> <br />9.
