AMENDMENT TO SOLID WASTE MANAGEMENT <br />AGREEMENT FOR COMMERCIAL HAULERS <br />WHEREAS, Sherburne County is contractually obligated to RRT (formally NRG, Energy) to ensure <br />that 300 tons per week of mixed municipal solid waste (MSW) generated within the boundaries of Easi <br />Sherburne County is delivered for processing to RRT's Elk River Resource Recovery Facility (Facility); and, <br />WHEREAS, Sherburne County is obligated under this agreement until August 31, 2009; and, <br />WHEREAS, Sherburne County and City of Elk River entered into a Solid Waste Management <br />Agreement for Commercial Haulers (Agreement) for the market delivery of MSW from the area defined as <br />East Sherburne County to the Facility until August 19, 2008; and, <br />WHEREAS, The Agreement is mutually beneficial for both commercial hauler and Sherburne County <br />as it establishes the commercial haulers allocated share of East Sherburne County's 300 tons of MSW per <br />week obligation to the Facility; and, <br />WHEREAS, An extension to the existing Agreements with commercial haulers would allow for the <br />County to maintain its existing contractual obligation to the Facility; and, <br />WHEREAS, The Commercial Hauler is willing to extend the Agreement until August 31, 2009 with the <br />understanding that all current terms and conditions of the Agreement shall remain unchanged throughout the <br />extension period. <br />NOW, THEREFORE, the parties agree as follows: <br />1. To extend the Solid Waste ManagementAgreement for Commercial Haulers until August 31, <br />2009. <br />2.
