Planning Commission Minutes <br />January 9, 2007 <br />Page 7 <br />Commissioner Offerman asked the City Engineer if MnDOT has any future plans for this <br />intersection. Terry Maurer, City Engineer, stated that permits are reviewed by an individual <br />who is not involved in the long-term planning. Mr. Maurer stated he is aware there will be <br />one interchange on Highway 10 in Elk River, but MnDOT states they are not in the position <br />to tell us when or where it will go, or how much right of way will be needed. <br />Chair Lemke asked for clarification regarding the controlled access onto 171 Avenue from <br />the site. Mr. Maurer explained that in order to allow access, the plat would need to be re- <br />approved with no restrictions on access onto 171 Avenue. He stated that the property <br />owner was aware of the restriction when the property was platted. He stated that problem is <br />conflicting movements of traffic, and that it is not a capacity issue, it is a safety issue. <br />Discussion followed regarding how to proceed with the request. Commissioner Anderson <br />stated that he felt all conditions should remain as recommended by staff, with the change to <br />allow lighting of the Super America letters. Commissioner Offerrnan suggested adding a <br />condition that all design standards of Mississippi Ridge be met, and all site lighting shall be <br />of cut-off style. <br />MOTION BY COMMISSIONER STEVENS AND SECONDED BY <br />COMMISSIONER ANDERSON TO RECOMMEND APPROVAL OF THE <br />REQUEST BY SUPER AMERICA FOR A CONDITIONAL USE PERMIT, CASE <br />NO. CU 07-01, WITH THE FOLLOWING CONDITIONS: <br />1. ALL COMMENTS OF THE CITY ENGINEER'S MEMO DATED <br />DECEMBER 7, 2006 SHALL BE ADDRESSED. <br />2. ALL COMMENTS OF MN DEPOARTMENT OF TRANSPORTATION <br />DATED DECEMBER 14, 206 SHALL BE ADDRESSED. <br />3. THE BUIDLING SHALL MEET ALL APPLICABLE BUILDING CODES. <br />4. THE BUILDING SHALL MEET ALL APPLICABLE FIRE CODES. <br />5. THE ACCESS ON 171sT AVENUE SHALL BE ELIMINATED. <br />6. THE DUMPSTER ENCLOSURE SHALL BE CONSTRUCTED WITH THE <br />SAME MATERIAL AS THE PRINCIPAL BUILDING. <br />7. THE MAXIMUM HEIGHT FOR A MONUMENT SIGN SHALL BE 10 FEET <br />AND THE MAXIMUM SIGN AREA SHALL BE 100 SQUARE FEET. THE <br />MONUMENT SIGN SHALL BE CONSTRUCTED OF BRICK OR FACE <br />BRICK . THE PROPOSED SIGN MEETS THIS STANDARD. <br />8. THE C-STORE AND THE CARWASH EACH ARE ALLOWED TWO WALL <br />SIGNS NOT TO EXCEED SEVEN PERCENT (7%~ OF THE BUILDING <br />WALL. THE C-STORE'S WALL SIGNAGE IS COUNTED ON THE <br />CANOPY. <br />9. ALL SITE LIGHTING SHALL BE OF A CUT-OFF CLASSIFICATION. <br />10. STAFF SHALL WORK WITH THE APPLICATION TO ENSURE THAT <br />THE MISSISSIPPI RIDGE DESIGN STANDARDS ARE MET. <br />11. THE CANOPY FACIA SHALL NOT BE ILUMINATED WITH THE <br />EXCEPTION OF THE PROPOSED BLUE "SUPER AMERICA" LETTERS. <br />12. A LETTER OF CREDIT IN THE AMOUNT OF 100% OF THE COST OF <br />LANDSCAPING SHALL BE SUBMITTED AT THE TIME OF BUILDING <br />PERMIT. <br />MOTION CARRIED 7-0. <br />
