Memo to Mayor and City Council <br />AS95-Ol <br />March 6, 1995 <br />Page 2 <br />• for ownership purposes, however, require agreements allowing access and <br />parking privileges. <br />The primary purpose for the Administrative Subdivision is to allow the <br />conveyance of land from the school board to the City of Elk River. This will <br />allow the City to have ownership of the land encompassed by both ice arena's <br />and the new parking facility. <br />Utilities/Easements <br />The survey of the subject property identifies four easements (A, B, C & <br />D) at various points around the building. These may be easements <br />that were granted to allow building expansions of the existing arena. <br />Additional information should be provided describing the purposes of <br />these easements. <br />Furthermore, as discussion in the conditional use permit report the <br />Fire Chief is requesting extending a waterline north through the <br />subject parcel to connect with adead-end line in School View Addition <br />(see Attachment A). Extending this utility should include an easement <br />through the proposed parcel. Secondly, Elk River Utilities has an <br />existing overhead powerline extending north of School Street to the <br />• southwest corner of the existing arena. With the new addition the <br />electric service will wrap around the west side of the ice arena to a <br />location along the north side. Once again it has been requested that <br />an easement be granted for this entire utility, from School Street to the <br />proposed transformer location north of the ice arena. This easement <br />should be minimum of ten (10) feet in width as requested by Elk River <br />Utilities. <br />Recommendation <br />It is recommended the City Council approve the Administrative Subdivision <br />creating approximately a 3 acre parcel to accommodate the existing and <br />proposed ice arena along with the associated parking with the following <br />conditions: <br />1. An approved cross access/cross parking agreement be accepted by both <br />parties. <br />2. An appropriate size drainage and utility easement be granted through <br />the subject property which will allow the extension of the waterline. <br />• 3. A ten foot drainage and utility easement be granted for the electrical <br />service from School Street to the ice arena. <br />
