I RESOLUTION NO. CITY OF ~LK RIVER COUNTY OF !SHERBURNE STATE OF MINNESOTA A RESOLUTION OF THE CITY COONCIL OF THE CITY OF ELK RIVER AUTHORIZING EMINENT DOM~IN AND ACQUISITION OF REAL PROPERTY IN ACCORDANCE WITH MINNESOTA STATUTES CHAPTER 117 FOR THE I 93rd N.W.AVENUE TRANSPORTATION CORRIDOR AND ADOPTING APPROVED APPRAISALS OF VALUE. Whereas, on February 20,2007, the City Council adopted Resolution No. 07-24, Authorizing Eminent Domain and Acquisition of Real Property in Accordance with Minnesota Statutes Chapter 117 for the 193rd N.W. Avenue Transportation Corridor. ("Resolution Authorizing Condemnation"); Whereas, the Resolution Authorizing ~ondemnation described certain real property to be acquired by the City for the 193rd Avenut:! Extension Project. ("Property"); Whereas, City staff has determined that it is necessary and advisable to make certain minor changes to the Property to be acquired ior the 193rd Avenue Extension Project. Whereas, the City staff has also obtained appraisals to estimate the just compensation due and owing to the owners ob the Property described in the Resolution Authorizing Condemnation; NOW, THEREFORE, BE IT RESO~VED by the City Council of the City of Elk River. 1. The City of Elk River staff is hereby authorized and directed to take all actions and to execute all documents and contracts necessary to acquire the Real Property identified on Exhibit A ("Revised Real Property"). 2. All references in the Resolution Authorizing Condemnation to the term "Real Property" shall be deemed to mean Revised Real Property. 3. The City ratifies all previous fmdings, resolutions and provisions in the Resolution Authorizing Condemnation. 4. The City hereby adopts, as its approved appraisal of value for the Revised Real Property the appraisals of Patchin Messner and Dodd dated June 29, 2007.
