EV 94-2 <br /> <br />ISSUE <br /> <br />Consider Resolution 94-_" vacating a thirty (30) foot drainage and utility <br />easement along the southeast property line of Oak Park Plaza. <br /> <br />ATTACHMENTS <br /> <br />. <br /> <br />Resolution No. 94,_ <br />Location Map <br /> <br />ANALYSIS <br /> <br />A thirty foot drainage and utility easement was dedicated as part of the Oak <br />Park Plaza Plat. During review of that plat, there was discussion regarding <br />the natural ridge along the southeast property line. This easement was put <br />in place to identify a buffer zone and protect the ridge line from development. <br /> <br />Riverside Development is requesting to vacate this easement to accommodate <br />some concept plans to develop the property with office buildings. Staff has <br />indicated to the developers that protecting the ridge and wooded area is a <br />primary concern with developing this site. On the other hand, a development <br />of office buildings provides a ideal transition between the commercial and <br />residential area to the east. However, under the present zoning of C3 <br />(Highway Commercial), several uses other than office could be developed on <br />the property; therefore, the natural ridge should be protected in its entirety. <br /> <br />. <br /> <br />Riverside Development's immediate plans are to plat one commercial lot at <br />the south end of the subject parcel. Within that proposed lot is a small <br />segment of the 30 drainage utility easement. This area could be vacated at <br /> <br />P.O. Box 490 · 13065 Orono Parkway.
