Therefore, it is possible that a Quit Claim deed from the City of <br />Elk River would deal with this issue. <br /> <br />Response to Engineers comments dated September 11. 2006 <br /> <br />1. See Item 6 above. <br />2. As indicated in Item 6 above, the City Subdivision Ordinance does not require the use of . <br />a 30 MPH curve on streets that are not arterial or collector streets. Many street <br />alignments exist in projects recently appr()ved by the City which do not meet the 30 MPH <br />design standard. The City ordinance requires street design to slow traffic and discourage <br />the use oflocal streets as through streets. <br />3. A full diameter cul-de-sac has been shown at the end of Kennedy Street and a call for the <br />sign has been added. <br />4. As indicated above, a Tree Preservation aild Landscape Plan has been provided. <br />5. We have included the.right turn lane from CSAH 33 to 207th Avenue in the previous <br />. submittal as acknowledged in the City Engineer's current review letter. We have <br />obtained the additional topographic information necessary to Jinalize the grading limits <br />and ditch re-alignment required for the turn lane and taper. This information will also <br />allow us to define the limits of the temporary slope easement that the applicant is <br />required to obtain from the adjoining property owner to the south. We will include <br />updated turn lane design with the next plan submittal. <br />6. Noted. <br /> <br />Response to Staff Review Received December 8. 2006 <br /> <br />Open Space Preservation Plat <br /> <br />As has been indicated in many meetings with staff, the developer does not wish to develop the <br />property as an "Open Space Preservation Plat.
