Park fee, based on the current rate. <br /> <br />Condition 14: Acknowledged; please proyide the Seal Coat fee, based on the current rate. <br /> <br />Condition 15: Acknowledged. <br />Condition 16: Acknowledged. <br />Condition 17: Acknowledged. <br />Condition 18: Acknowledged. <br />Condition 19: Acknowledged. <br /> <br />An item not addressed under the above conditions, but of considerable concern, is the vacation of the <br />Road and Utility Easement along the common line between the North Half of the Southwest Quarter of <br />the Southwest Quarter, and the South Half of the Southwest Quarter of the Southwest Quarter. <br /> <br />After discussion with the Sherburne County Engineer, Rhonda Lewis, we are proposing to provide a <br />temporary easement for possible future County Road 33 over the south 66.00 feet of the Southwest <br />Quarter of the Southwest Quarter, of Section 24, Township 33, Range 26, Sherburne County, Minnesota. <br /> <br />We understand the following: <br /> <br />1. All or part of this easement may be used for the future right-of-way of County Road 33 if the <br />same is approved for construction. <br />2. When a right-of-way for County Road No. 33 is determined, any portion of this easement not <br />used by the County Road No. 33 right-of-way will be terminated. <br />3. This right-of-way will be provided to the City of Elk River as a temporary easement for road, <br />drainage and utility purposes, by a document to be recorded at the same time and subsequent to <br />the recording of the Final Plat. <br />4. The process to vacate the existing 66-foot road and utility easement will run concurrent with the <br />final plat approval of the proposed plat. <br /> <br />Page 4 <br />
