Should the Preliminary plat not be <br />approved, then all subsequent recommendations become null and void: the property would not be <br />rezoned, or the urban service district be eXtended. <br /> <br />Analysis <br />Comprehensive PJan Amendment. The subject property is located outside of the urban services <br />district. The applica.nt is requesting a comprehensive plan amendment to extend water and sanitary <br />sewer services to the property. In exchange, the applicant is proposing the dedication of 29.75 acres <br />to the city, to be used for the construction of a future school The land would be gtaded and seeded <br />for stabilization purposes. There has been some discussion that should the school district not use <br />the land within a period of time (presently Undefined), the land would remain under city ownership, <br />for park and open space purposes. An agree!D.ent should be completed between the School District <br />and the City regarding this issue. <br /> <br />Rezoning The subject property is zoned Ria.. The applicant is proposing a PUD zoning, which <br />pemri.ts . g1:ea.ter design flexibility by allowiD.g modiE.cation of lot and building area., among other <br />options. The PUD development must remain consistent with the intent and purpose of the <br />comprehensive plan, while hot adversely affecting adjacent property. <br /> <br />The plan as presented appears appropriate with an extension of the urban services area, and helps <br />address a need for park land and school expansion in this area. of the community. <br /> <br />Conditional Use Permit A Conditional Use Permit is necessary for a property to be rezoned PUD, <br />versus standard zoning. Through the review and negotiation of the plat, Staff and the developer <br />have worked together to m;nim;7.e any potential negative impacts on the surrounding property, <br />while preserving the character of the community. <br /> <br />Comprehensive Plan <br />The subject property is guided for rural residential. With the proposed amendment to the <br />comprehensive plan, the land use as proposed appears to be consistent with the surrounding area, <br />which is predominately residential, with some pockets of institutional (School). <br /> <br />Lots. The proposed prelim;mny plat includes 452 single family residential lots, and 6 outlots on <br />276.82 acres. Lots range in size from 9,750 to 36,887 square feet, with th.e average lot size being <br />12,815 square feet. The gross density proposed is 1.6 units per acre. Net density, exclusive of the <br />school and County Right of way, is 1.88 units per acre. The lot size appears consistent with the <br />direction given by the City Council, and of an area served by urban services. The layout is largely <br />consistent with the original concept plan reviewed by the phlf'1n;ng Commission and City Council <br />last winter. <br /> <br />There are two exceptions in the northwest comer of the plat that should be addressed through the <br />planning process. These exceptions are existing home sites owned by other parties, not requesting <br />services or platting at this time. <br /> <br />The northern one of the two exceptions, owned by Mr. Ron Middlestadt, is in the extreme <br />northwest comer of the plat.
