The proposed subdivision will not conflict with easements of record or with <br />easements established by judgment of a court. <br /> <br />Response: The Project will not conflict with any easement of record or easements <br />established by a judgment of a court. <br /> <br />7. The proposed subdivision will not have an undue and adverse impact on the <br />reasonable development of neighboring land. <br /> <br />Response: The Project has not been demonstrated to have an undue or adverse <br />impact on the reasonable development of neighboring land. To the contrary, the <br />Project has been designed to accommodate the reasonable development of <br />neighboring land. <br /> <br />8. The proposed subdivision is not premature. A subdivision is premature if any of <br />the following exists: <br /> <br />a. Lack of adequate storm water drainage. <br />b. Lack of adequate roads. <br />c. Lack of adequate sanitary sewer systems. <br />d. Lack of adequate off-site public improvements or support systems. <br /> <br />Response: The Project is not premature. The surrounding land uses are presently <br />used or guided for similar Rural Residential land uses. <br /> <br />The desire or preference of City staff to develop the Project as an Open Space Preservation plat is <br />neither dictated nor required by the Elk River Code of Ordinances or the Elk River <br />Comprehensive Plan. Accordingly, we respectfully request approval of the Cranberry Ridge <br />preliminary plat as submitted.
