Stat. ~ 16A.15 <br />This Contract is between the State of Minnesota, acting through its Commissioner of Transportation, and Contractor as follows: <br /> <br />Whereas: This contract provides, among other things, for the Grading, Aggregate Base, Concrete Curb & Gutter, Storm Sewer, Bike Path, and Bituminous <br />Surfacing on County Highway (CH) 40 between County State Aid highway (CSAR) 12 to CSAR 13; and <br /> <br />Whereas: The City of Elk River requests the installation ofa bike path on the west side ofCH 40 between 19181 Avenue and CSAR 13 (Station 71+40 thru <br />station 84+20); and <br /> <br />Whereas: The installation of the bike path will require additional 24" RC Pipe to be installed between structures 6A and 6B at station 77+00 left; and <br /> <br />Whereas: A 24" RC Pipe will be installed at centerline station 45+00 to allow drainage from the east side to the west side of CH 40; and <br /> <br />Whereas: The contract did not provide for Muck Excavation and muck was found under the proposed roadway between station 74+00 to 79+00. Granular <br />borrow will be hauled in for the excavated muck material. <br /> <br />NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AND UNDERSTOOD THAT: <br />I) The contractor has agreed to perform all the above work in accordance with the Plans and Specification and all work shall meet the requirements ofthe <br />MN/DOT specifications. <br /> <br />2) The contractor shall construct a 10' paved bike path as shown on the typical section of the construction plans. The bike path shall be constructed 8' <br />from the back of curb. Payment to construct the bike path shall be made at the contract unit bid price. <br /> <br />3) The contractor shall install an additional 16' ofthe 24" RCP between structures 6B and 6A at the percent of grade indicated on the construction plans. <br />Payment to install16LF- 24" RCP shall be made at the contract unit bid price. <br /> <br />4) The contractor shall install a 24" RC Pipe culvert with aprons at station 45+00. The pipe shall be installed at elevation 928.00 on the west side and <br />928.50 on the east side. It shall meet the requirements of MnDOT specifications and MnDOt detail plates 31 OOG, 3000L, & 3145F Payment to install <br />the 24" culvert shall be made at the agreed unit bid price. <br /> <br />5) The contractor shall remove all muck material between stations 74+00 to 79+00 that exists under the proposed roadway. The muck material shall be <br />stock piled and placed on the in-slopes for final restoration. Payment to excavate, stock and place muck material shall be made at the agreed unit bid <br />price. <br /> <br />6) The granular material required to be hauled in for the muck excavation will be paid at unit bid price. This item will overrun the original contract and is <br />not a part of this supplemental agreement. <br /> <br />7) The items listed above shall include all materials, labor and any other appurtenances necessary to complete the work. <br /> <br />8) The contractor will not make claim of any kind whatsoever for any other expenses which he may have incurred or which he hereafter incurs, in <br />performing the work and furnishing the materials required by this agreement. <br /> <br />9) Zero (0) additional working days will be added to this contract. <br />
