<br />Todd Anderson, Boy Scouts <br />June 20,1994 <br /> <br />Page 2 <br /> <br />e <br /> <br />adequate side slopes and storage capacity for the storm water drainage needs <br />in the area. The building will be positioned on the property to meet all <br />required setbacks and will have a bituminous driveway and parking area <br />servicing the three storage units. <br /> <br />Along with the regrading of the pond, there will be additional landscaping <br />planted around the perimeter to meet the city's landscaping requirements. It <br />is anticipated the Boy Scouts will be able to accomplish this through their <br />volunteer efforts much like the construction of the building. <br /> <br />The building itself will resemble a residential garage and be compatible with <br />the Mini Storage facility to the west. Three (3) 10 x 8 overhead doors will <br />face 1911/2 Lane providing access to each of the storage units. <br /> <br />e <br /> <br />The City Attorney has recommended that, in situations where organizations <br />construct buildings on city property, the city maintain ownership of those <br />buildings and enter into a lease agreement outlined with terms and <br />conditions for the use of that building. At this time, the city is dealing with <br />two situations that would fit this scenario. The first being the Boy Scout <br />building and the second is the Chamber of Commerce building at Highway 10 <br />and Main Street. This type of arrangement, whereby the city owns the <br />building and leases it back, provides the city with the most protection and <br />control while establishing consistent city policy for future requests. <br /> <br />PLANNING COMMISSION RECOMMENDATION <br /> <br />The Planning Commission unanimously recommended approval of the <br />conditional use permit request by Todd Anderson, representing the Boy <br />Scouts of Elk River, to construct a mini storage facility with the conditions <br />stated in the attached staff report. The Planning Commission also added two <br />conditions: <br /> <br />5. An authorized representative of the City of Elk River sign the <br />conditional use permit application as the property owner. <br /> <br />6. The lease agreement be structured providing use of the building <br />be limited to the Boy Scouts of Elk River and that there be no <br />other subleasing or commercial activity associated with the mini <br />storage facility. <br /> <br />e <br /> <br />anderson. council <br />
