No work is to be accomplished prior to the spring of 1994. Mr. Hartman indicated <br />that his home is part of a Christmas Parade of Homes for charity and he would prefer <br />that the driveway and yard not be disturbed prior to that time. Therefore construction <br />could not be undertaken prior to spring of 1994. <br /> <br />4. The agreement of a fair price for the granting of the easement. Mr. Hartman <br />indicated this could be either a pro-rata cost based on the area of the easement vs. the <br />value of his lots or even a reduction in the value of his home, thus lowering his taxes <br />due to the encroachment of an easement across his property. <br /> <br />We have discussed the potential for a change order to meet Mr. Hartman's conditions with <br />the low bidder. They have indicated a willingness to pursue such a change order . We, <br />however, at this point in time, do not have a cost-estimate for the City Council to consider. <br />Also, the low bidder indicated they would prefer not to construct the project until the spring <br />of 1994. They are very concerned about 191st Avenue in Deerfield 3rd relative to <br />restoration. They believe that at this time of year construction of pipe along that alignment <br />would make it very difficult to provide adequate restoration for people accessing their <br />properties or driving that particular route. They are also concerned with the portion that goes <br />downhill between Deerfield 3rd and Royal Oaks. The inability to restore that could lead to <br />substantial erosion in the spring, which also would impact Mr. Hartman's property. <br /> <br />Given the position of Mr. Hartman relative to the easement and to the contractor's desires <br />relative to actual construction of the improvement, we would recommend that the City <br />Council give direction to negotiate the cost of a potential change order and continue <br />discussions with Mr. Hartman' relative to the easement acquisition. At such time that we <br />have completed both discussions, we could then present back to the City Council the <br />construction bid, the cost of the change order, and the potential cost of acquiring the <br />easement.
