CU 93-21 <br /> <br />ATTACHMENTS <br /> <br />Location Map, Zoning Map, Land Use Map, Site Plan, Floor Plan <br />of Restaurant, List of Property Owners. <br /> <br />PROPOSED LOCATION <br /> <br />508 Freeport Avenue (Elk River Plaza immediately south of <br />Pamida, formerly the Billiard Center), Elk River, MN. <br /> <br />REQUESTED ACTION <br /> <br />A conditional use permit to amend Elk River Plaza PUD Agreement <br />allowing a pizza and pasta restaurant facility. <br /> <br />e ZONING/LAND USE <br /> <br />PUD (Planned Unit Development)/HB (Highway Business) <br /> <br />BACKGROUND <br /> <br />In 1987, Big Wheel Rossi built a new building of approximately <br />16,000 sq ft on Lot 5, Block 1, Elk River Plaza, Second <br />Addition. This development was consistent with the PUD <br />Agreement at that time. In 1989, an amendment to the PUD <br />Agreement to allow recreational facilities was approved by the <br />City Council. Prior to this, another amendment was approved by <br />the City Council permitting professional and business offices. <br /> <br />The original PUD Agreement for Parcel F (aka Lot 5, Block 1, <br />Elk River Plaza Second Addition) stated permitted uses would <br />consist of "retail establishments" in accordance with the C1, <br />C2, and C3 zoning text. Since a restaurant is not defined as a <br />retail establishment, the PUD Agreement must be amended <br />accordingly.
