AS 93-03 <br />AND V 93-03. <br /> <br />APPLICANT <br /> <br />Moyer and Weicht Investment, Inc., represented by John Weicht, <br />PO Box 360, Elk River, MN. <br /> <br />REQUESTED ACTION <br /> <br />e <br /> <br />This request is for an administrative subdivision to divide a <br />lot containing an existing duplex into two lots with a zero lot <br />line. The applicants are also requesting variances on lot <br />width and size for both lots they are proposing to create. <br />Only the City Council reviews the administrative subdivision <br />request, therefore, the Planning Commission only reviewed the <br />variance request. There is a site plan attached to this memo <br />showing the duplex and garages as well as the dimensions of the <br />proposed lots. <br /> <br />SITE ZONING <br /> <br />R2/Townhouse District <br /> <br />SURROUNDING ZONING <br /> <br />West - C2/0ffice District <br />North and South - R2/Townhouse District <br />East - R1c/Single Family Residential <br /> <br />LEGAL DESCRIPTION <br /> <br />Lot 2, Block 3, Burrell's Addition. The legal description used <br />to develop a list of property owners within a 350 foot radius <br />of the affected property was correct. However, the public <br />hearing notice in the Star News incorrectly stated Lot 2, Block <br />2, Burrell's Addition. <br /> <br />BACKGROUND <br /> <br />e <br /> <br />Mr. Weicht constructed a duplex and detached garages on this <br />lot in 1984. Both the dwelling units and the garages were <br />presumably built with two 1 hour fire walls to accomodate a <br />future lot line as far as building code. <br /> <br />P.O.
