<br />e <br /> <br />e <br /> <br />e <br /> <br />Variance, Moyer & Weicht Investments <br />May 11, 1993 <br /> <br />Page 2 <br /> <br />In 1984, lot standards for an R2 lot were 30 feet in width and <br />3,500 square feet in size. Current R2 lot standards are 60 <br />feet in width and 6,000 square feet in size. <br /> <br />VARIANCE <br /> <br />Staff refers the City Council to Section 900.40 of the Elk <br />River Code of Ordinances "Variances", for the five standards to <br />consider when reviewing this request. Mr. Weicht feels he <br />meets the five standards with this request. He states as his <br />hardship, the fact that an existing structure was built with a <br />subdivision in mind, at a time when his proposed lot sizes <br />would have met City code. Further, he feels that the need for <br />these variances are not a consequence of his own actions (City <br />code changed). Lastly, Mr. Weicht feels that approving the <br />variance would not detrimentally alter the health, safety, or <br />welfare of the residents of the City or neighborhood since the <br />structure is already there. <br /> <br />RECOMMENDATION <br /> <br />The Planning Commission recommended approval of these variances <br />contingent upon verification that building codes for a zero lot <br />line structure are met. Staff is also recommending approval of <br />the administrative subdivision contingent on the Council <br />approving the variances. <br />
