<br />e <br /> <br />e <br /> <br />e <br /> <br />Stevens' Conditional Use Permit <br />May 11, 1993 <br /> <br />Page 2 <br /> <br />above mentioned <br />non agricultural <br />54 feet, for a <br />a site plan showing <br />of the accessory <br /> <br />The Stevens' are proposing to exceed the <br />standards by having a single, detached, <br />accessory structure that measures 30 feet by <br />total of 1,620 square feet. Attached is <br />the Stevens' house and the proposed location <br />structure. <br /> <br />PROCESS <br /> <br />The mechanism to allow exceptions to the three standards the <br />Stevens' wish to exceed is a conditional use permit. Staff <br />refers the City Council to Section 900.42 of the Elk River Code <br />of Ordinances for the seven standards to consider when <br />reviewing a conditional use permit request. <br /> <br />Attached is a letter from the Stevens' dated April 1, 1993. In <br />this letter they point out that a precedence for larger metal <br />skin buildings has been established in their neighborhood <br />(Greenhead 3rd Addition). Further, allowing an encroachment on <br />the 300 foot setback will allow their building to be built <br />among trees and, therefore, screened naturally. The attached <br />site plan shows the distance from the proposed accessory <br />structure to a lot lines but does not show the distances to <br />neighboring residences. One last note, the Stevens' currently <br />do not have any detached accessory structures on their <br />property, only an attached garage. <br /> <br />RECOMMENDATION <br /> <br />After considering the concerns of the Stevens' neighbors, the <br />Planning Commission recommended a compromise that the Stevens' <br />accepted. The Planning Commission felt the Stevens' request <br />would meet the seven standards for a conditional use permit <br />under the following conditions: <br /> <br />1. THE ACCESSORY STRUCTURE BE NO CLOSER THAN 175 FEET <br />FROM NEIGHBORING RESIDENCES. <br /> <br />2. THE TOTAL SQUARE FOOTAGE OF THE ACCESSORY STRUCTURE <br />NOT EXCEED 1,400 SQUARE FEET. <br /> <br />3. THE STRUCTURE BE INSULATED FOR SOUND DEADENING. <br />
