Is required by proper authority to continue in such military or naval service <br />beyond the time herein limited for such leave. <br /> <br />Military Leave for Uniformed Service <br /> <br />Except as provided otherwise in the National Guard and Reserve Leave Policy above, employees <br />who are members of, apply to perform, or have an obligation to perform service in a uniformed <br />service will be granted an unpaid leave of absence to perform such service. Military leave <br />requests shall be made to the immediate supervisor. The term "uniformed service" means the <br />Armed Forces, the Army National Guard and the Air National Guard when engaged in active <br />duty, active duty for training, initial active duty for training, inactive duty training, full-time <br />National Guard duty, the commissioned corps of the Public Health Service, and any other <br />category of persons designated by the President in time of war or emergency. As soon as an <br />employee is informed of the dates of the military training, he or she should notify his or her <br />supervisor and request a leave of absence, even if he or she has not yet received written orders. <br /> <br />In the case of an employee whose period of military service is less than 31 days, an employee <br />must report back to his or her job at the first regularly scheduled shift after the completion of <br />military service and the time required for return from the place of military service to the place of <br />civilian employment. An employee called to active duty for more than 30 days, but less than 181 <br />days, must report back to his or her job not more than 14 days after the completion of his or her <br />military service. An employee called to active duty for more than 180 days must report back to <br />his or her job not more than 90 days after the completion of his or her military service. <br /> <br />This Policy is not intended to preclude leave with pay as may be provided in the National Guard <br />and Reserve Leave Policy above. <br /> <br />Jury/witness Duty Leave <br /> <br />Employees will be allowed a leave of absence pursuant to State Statute without restriction or <br />sanction when called for jury duty. <br /> <br />. An employee performing jury duty or subpoenaed as a witness in court or <br />voluntarily serving as a witness on behalf of the City in a case in which the <br />City is a party will receive the difference between hislher regular rate of pay <br />and the amount received as juror or witness up to the maximum allowed by <br />state or federal law . <br />. The employee must notify hislher supervisor and complete a leave of absence <br />form within 48 hours of receiving call for jury duty. <br />. An employee excused or released from jury duty during hislher regular work <br />hours must report to hislher supervisor immediately thereafter. <br />. Time spent on jury duty will not count as time worked in computing overtime. <br /> <br />20 <br />
