The applicant chose to implement the DNR's <br />recommendation of a 10:1 slope on the back portion of the <br />pond. This area would have an average depth of 3-4 feet. An <br />unexcavated island is planned in the middle of the south 1/2 of <br />the pond. Staff has enclosed a brochure from the DNR regarding <br />excavation of ponds for water fowl which gives recommendations <br />on how to properly construct wildlife ponds. <br /> <br />DRAINAGE <br /> <br />At the December meeting, a few neighbors were present to <br />express their concerns with the proposed project including what <br />affect this excavation would have on drainage in the area, <br />traffic concerns, noise and other disruptions to a residential <br />area. Staff feels this proposed excavation should not have an <br />affect on drainage in the area if certain precautions are <br />taken. City engineer, Terry Maurer, indicated if the City <br />Council approves a general concept for the proposed excavation, <br />the City should require more detailed plans before excavation <br />begins (i.e., elevations of lowest floors in the area, and <br />existing and proposed topography). These details are necessary <br />to ensure the drainage will not be affected and to properly <br />inspect the work in progress. Mr. Maurer's comments are <br />available in the attached letter dated January 20, 1993. Mr. <br />Shoemaker is considering a clay liner on the east side to <br />ensure the pond retains water. This may be considered fill in <br />a wetland which would not be allowed. <br /> <br />NOISE <br /> <br />The City ordinance regarding excavation (Section 720) places <br />standards on these types of activities. Hours of operation are <br />limited from 7 a.m. to 7 p.m., Monday through Saturday. <br />Maximum noise levels shall comply with the limits established <br />by the MPCA and the EPA. Because this excavation is in a <br />residential area, more restrictive standards may be desired. <br />The Planning Commission is recommending work commence no <br />earlier than 8 a.m. <br /> <br />SAFETY <br />The issue of safety should be addressed in an <br />liability. The applicant has slightly altered <br />depth to a safer level. Staff is recommending <br />of 3-4 feet for safety reasons. <br /> <br />effort to limit <br />the slope and <br />a maximum depth <br /> <br />FUTURE EXCAVATIONS <br /> <br />Staff recommends the City take a look at the bigger picture <br />regarding excavation of wetlands. A study of wetlands should <br />be conducted to determine which ones should remain untouched <br />and which ones the City would allow to be altered. For <br />background information, I have attached an article from the <br />January 3, 1993, Minneapolis Star Tribune regarding wetlands in <br />the Metropolitan area. <br />
