<br />create traffic beyond what should be expected in a <br />residential area. <br /> <br />. <br /> <br />Subparaqraph 5: Staff feels the use will be detrimental <br />to people because of excess traffic and noise, and <br />possibly smoke, fumes, and dust. It would be unfair to <br />subject people in a residential area to this type of use <br />for a period of two years. <br /> <br />Subparaqraph 6: If the request were approved, a natural <br />feature (the wetland) would be altered but not destroyed. <br />Staff is not aware of other scenic or historic features in <br />this area. <br /> <br />Subparaqraph 7: If approved, the use would be subject to <br />other codes including hours of operation for construction <br />activities, soil erosion standards, slopes, etc. A <br />mineral excavation license would not be required as the <br />use is proposed to be completed within a 2 year time frame. <br /> <br />RECOMMENDATION <br /> <br />. <br /> <br />Staff is recommending denial of the request for a conditional <br />use permit to excavate 31,250 cubic yards of black dirt in a <br />Type 3 wetland in the Royal Oaks Ridge subdivision. Staff <br />feels this request does not meet the seven standards for a <br />conditional use permit. Staff is particularly concerned with <br />the traffic generated by the proposed use and the affect that <br />the use would have on the residential area due to the magnitude <br />and duration of the project. <br /> <br />If the applicant were to find an alternative route for trucks <br />to use and if the plan were altered to comply with the DNR <br />recommendations which would downsize the pond and thus reduce <br />the length of time it would take to complete the project, staff <br />would be more supportive of the request. These changes would <br />alleviate the concerns regarding traffic and other disruption <br />to the residential area. Further, staff would recommend the <br />following stipulations: <br /> <br />1. <br /> <br />THE TRUCKS <br />ALTERNATIVE <br />STREETS. <br /> <br />ENTER AND EXIT THE SITE FROM AN <br />ROUTE, NOT THROUGH THE RESIDENTIAL <br /> <br />2. <br /> <br />FOR SAFETY, AS WELL AS WILDLIFE PURPOSES, THE <br />MEET THE DNR RECOMMENDATIONS OF 10 TO 1 SLOPES, <br />AVERAGE DEPTH, MAINTAIN NATURAL VEGETATION ALONG <br />EDGE, AND IRREGULAR SHORELINE. <br /> <br />POND <br />2-3' <br />THE <br /> <br />3. NO FILL BE PLACED WITHIN THE WETLAND BOUNDARY. <br /> <br />4. APPROVAL IS CONTINGENT ON BWSR AND SWDC COMMENTS. <br /> <br />. <br /> <br />5. <br /> <br />THE PROJECT BE DOWNSIZED IN DURATION AND SIZE TO <br />MINIMIZE THE AFFECT OF THE OPERATION ON THE <br />RESIDENTIAL AREA. <br />
