Application for CUP/License <br /> <br />Hi Rebecca: <br /> <br />I spoke with Pete Umland at Midwest regarding the technical comments contained in my memo on <br />the renewal of the CUP/license, dated March 27, 2006. <br /> <br />. Existing conditions plan - He acknowledged that the contours and the aerial photo did not <br />match. He indicated that he would "see what he could do" to get a more accurate plan. <br />. Reclamation - No reclamation has been done. None is planned till the entire site (Phase A-D) <br />is completed because "they need to have room to stockpile" and "they need to match their <br />neighbors operations" He indicated it will take 20 years to mine the site. I told him this was <br />too long not to do any reclamation. I told him he needed to explain his timing and justify his <br />proposed reclamation. I told him this did not match the intent of City's ordinance. This is <br />unresolved. <br />. Groundwater - He said the elevations in the plan are based on the data from the EIS. I said <br />that was ok but we have better data and we need to adjust the basegrade upward. He <br />affirmed that Midwest does not intend to excavate below the groundwater table. He <br />indicated that they would modify the reclamation plan to be consistent with the new info <br />available. <br />. Surface water - no surface water for excavated areas flows offsite, with the exception of the <br />limited area near the entrance. He indicated that "overflow pipes" refer to culverts beneath <br />access roads and that the storm water retention ponds do not have outlets. <br />. Spill plans - An spec plan is not required for the site since there total petroleum storage is <br />less than 1320 gallons (tanks and drums).
