He further stated the owner must sign off on the city application <br />for a CUP. <br /> <br />Chair Anderson stated he doesn’t want to dedicate parking spaces for car sales, the property <br />will be an eyesore, and he is concerned of public safety. <br /> <br />Commissioner Ropp stated the CUP will impede development of surrounding property. He <br />stated it will be more difficult to lease the adjacent vacant spaces. <br /> <br />Commissioner Westgaard stated he agreed that this is not the best use for this site but it is an <br />allowable use and the Commission lacks sufficient findings for denial. <br /> <br />Commissioner Offerman stated finding # 3 and #7 would be met but he felt this item <br />should be continued in order to get more information from the applicant. <br /> <br />Commissioner Stevens concurred. He stated he is unclear if overnight parking is allowed in <br />this lot. <br /> <br />Mr. Harlicker stated the city does not control overnight parking in private lots. <br /> <br />Commissioner Scott stated he concurs with Commissioner Lemke but he is not comfortable <br />approving the CUP without more conditions on applicant such as better signage control <br />over the parking storage spaces. <br /> <br />Mr. Leeseberg stated the applicant does meet the requirements of the C3 zoning and could <br />be approved with conditions. <br /> <br />MOVED BY COMMISSIONER STEVENS AND SECONDED BY <br />COMMISSIONER OFFERMAN TO RECOMMEND TO THE CITY COUNCIL <br />DENIAL OF CASE NO. CU 04-24 BASED ON THE FINDING THAT THE <br />REQUEST CANNOT MEET CONDITIONS 1, 3, AND 7 OF THE CITY CODE <br />REQUIREMENTS FOR ISSUANCE OF A CONDITIONAL USE PERMIT: <br /> <br />1. WILL NOT ENDANGER, INJURE, OR DETRIMENTALLY AFFECT <br />THE USE AND ENJOYMENT OF OTHER PROPERTY IN THE <br />IMMEDIATE VICINITY OR THE PUBLIC HEALTH, SAFETY, <br />MORALS, COMFORT, CONVENIENCE OR GENERAL WELFARE OF <br />THE NEIGHBORHOOD OR THE CITY. <br /> <br />Concern with vehicles being stored on a long term basis in the parking lot. <br /> <br />3. WILL NOT IMPEDE THE NORMAL AND ORDERLY <br />DEVELOPMENT AND IMPROVEMENT OF SURROUNDING <br />VACANT PROPERTY. <br /> <br />The use would impede the leasing of other vacant units in the strip mall. <br /> <br />7. WILL FULLY COMPLY WITH ALL OTHER REQUIREMENTS OF <br />THIS CODE, INCLUDING ANY APPLICABLE REQUIREMENTS AND <br />STANDARDS FOR THE ISSUANCE OF A LICENSE OR PERMIT TO <br />ESTABLISH AND OPERATE THE PROPOSED USE IN THE CITY. <br /> <br />
