9 <br />ARTICLE 15. SICK LEAVE <br />The Union shall be eligible to accrue and use Sick Leave consistent with the city Personnel <br />Policy Manual. In the event the City desires to change Sick Leave in the Personnel Policy <br />Manual, the City and Union shall open the contract for this lone provision. <br />15.1 Minnesota Paid Family and Medical Leave <br />The Union will follow the December 2025 Personnel Policy Manual language which will be <br />grandfathered in the case of subsequent policy changes. <br />15.2 Injury on Duty <br />Employees in the classification of CSOII/Evidence Technician injured during the active <br />performance of their duties for the Employer en route to or from, or on event scene shall be <br />paid the difference between the fulltime Employee’s regular pay and worker’s compensation <br />insurance payments for a period not to exceed thirty (30) working days per injury following an <br />initial three (3) day waiting period. Injury on Duty (IOD) will not be charged to the regular <br />fulltime employee’s vacation, sick/ESST leave, or other accumulated leave time. Full shifts off <br />work due to injury will be counted as one day IOD. Partial shifts off work due to injury will be <br />counted by the quarter hour toward the 30 day (240 hour) IOD benefit. Time off of work on the <br />initial day of injury and the three (3) working days initial waiting period per injury shall be <br />charged to the regular fulltime Employee’s sick/ESST leave account less worker’s compensation <br />insurance payments. <br />ARTICLE 16. BEREAVEMENT LEAVE <br />The Union shall be eligible for Bereavement Leave consistent with the city Personnel Policy <br />Manual. In the event the City desires to change Bereavement Leave in the Personnel Policy <br />Manual, the City and Union shall open the contract for this lone provision. <br /> <br />ARTICLE 17. SEVERANCE <br />An employee resigning employment may be eligible for a cash payment for a portion of unused <br />sick leave. To receive a severance payout, the following conditions shall be met: <br />▪ The employee must earn sick leave per the Sick Leave policy above; and <br />▪ The employee must leave in good standing, not terminated by the city; and <br />▪ S/he must provide proper notice of resignation as stated above with city administrator <br />discretion; and <br />▪ S/he must execute a release of claims. <br /> <br />17.1 Payment shall be based on the consecutive years of leave-eligible service completed by <br /> the employee with the City of Elk River and his/her accrued sick leave balance. Payment <br /> shall be at the rate of pay when the resignation is submitted. <br /> <br />17.2 For Employees hired before August 8, 2023, and completing two (2) years of consecutive <br /> service, the severance payment is calculated at fifty percent (50%) of the accumulated <br />Page 71 of 111
