1 <br />238329v1 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />RELEASE <br /> <br /> <br /> This RELEASE is granted this 17th day of February 2026, by the CITY OF ELK RIVER, <br />a Minnesota municipal corporation ("City"). <br /> <br /> WHEREAS, a Warranty Deed dated May 12, 1988 and filed on May 23, 1988 with the <br />Sherburne County Recorder’s Office as Document No. 218685 (“Deed”) included a grant of a <br />drainage easements in favor of the City; <br /> <br />WHEREAS, there was no action by the City accepting the drainage easements contained in <br />the Deed and the drainage easements identified in the Deed exceeded the needs of the City; <br /> <br />WHEREAS, the City obtained a Grant of Easement for Drainage and Utility Purposes dated <br />January 5, 1999, filed on February 12, 1999 with the Sherburne County Recorder’s Office as <br />Document Number 383403 (“Grant of Easement”) over the property within the Deed which addressed <br />the City’s needs for drainage and utility purposes; <br /> <br /> WHEREAS, the City has been requested by the owner of the property legally described in <br />the Deed to release and discharge the property subject to the Deed from the drainage easements <br />contained within the Deed; <br /> <br /> WHEREAS, the drainage easements easement contained within the Deed are no longer <br />necessary and the Grant of Easement satisfies the City’s needs for drainage and utility purposes <br />over the property contained within the Deed. <br /> <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City of Elk River, Minnesota that the <br />drainage easements in favor of the City contained in the Deed are released and discharged. <br /> <br /> <br /> ADOPTED this 17th day of February 2026. <br />Page 65 of 395
