This deed included a grant of drainage and utility easements in favor of the city.
Unfortunately, there was no formal action by the city to accept the easements, and the rights granted to
the city exceeded its needs.

The city obtained drainage and utility easements over the property in 1999 to address the identified needs at
that time. This action created an overencumbrance of easements on the property, and the owner has
requested that the city release the unneeded easements conveyed by the 1988 warranty deed.

The city acquired all necessary easements via the 1999 grant of easements and does not need those
previously conveyed. Staff recommends approving the attached release as it relates to the easements
conveyed via warranty deed.

Financial Impact
None

Mission/Policy/Goal
Ethical, efficient, and responsible.

Attachments
1.
