Leave Benefits <br />The city and state and federal law provides leaves of absence according to the following <br />policies. A Leave Requestform must be completed for foreseeable leaves other than <br />vacation. Forms are available on AccessE/kRiveror from Human Resources. When <br />possible, advance notice of a leave should be provided to the employee's department <br />director so work schedules can be adjusted accordingly. Many types of leave below have <br />notice requirements. It is the employee's responsibility to review these policies and follow <br />the notice requirements. Notice is not considered given until a Leave Requestform has <br />been submitted. <br />Not all types of leave are compensated. Employees taking FMLA leave are required to take <br />vacation, sick, ESST, or compensatory time concurrently, unless they are also taking MN <br />Paid Leave. An employee will need to meet the requirements of each form of leave <br />separately and all eligible leaves will run concurrently, as allowed by law. Leave requests <br />will be evaluated on a case -by -case basis. <br />Employees shall record worked hours or use only one type of paid leave for each <br />scheduled work hour. Time off without pay is not allowed outside of the leave policies <br />below. <br />Except as otherwise stated, all paid time off taken under any of the city's leave programs <br />must be taken concurrently, or, when allowed by law, consecutively, with no intervening <br />unpaid leave. The city will provide employees with time away from work as required by <br />state or federal statutes if there are requirements for such time off that are not described <br />in the personnel policies. <br />The city will not discharge, discipline, penalize, interfere with, or otherwise retaliate or <br />discriminate against an employee for asserting leave rights in accordance with these <br />policies. <br />Vacation Leave <br />Paid vacation leave is provided for regular, full-time employees and on a prorated basis for <br />eligible part-time employees. To be eligible, part-time employees must work a set schedule <br />with a minimum of forty (40) hours per biweekly pay period. Most temporary, seasonal, <br />and part-time employees are not eligible for vacation benefits. <br />Vacation leave is accrued based on consecutive years of leave -eligible service. To <br />determine an employee's vacation accrual rate, years of service will include all continuous <br />time the employee has worked at the city in a position that is eligible for paid leave <br />(including authorized unpaid leave). Employees who are rehired after terminating city <br />employment will not receive credit for their prior service unless specifically negotiated at <br />the time of hire. <br />Leave -eligible employees hired before December 31, 2020, may carry more than 240 hours <br />Page 18181 <br />Page 172 of 447 <br />
