Employees will be paid overtime in accordance with the FLSA. Actual time worked will be <br />used for determining overtime payment, with no consideration to the one -hour minimum <br />call out pay provision for firefighter pay nor to paid leave time in the employee's full time <br />position. For example, a false alarm that requires 15 minutes of work will be counted as 15 <br />minutes for FLSA purposes even though the minimum call out of one hour of pay would <br />apply for firefighter pay purposes. <br />By advance mutual agreement, overtime earned for performance of fire department <br />activities shall be paid at one and one-half times the employee's firefighter pay rate. <br />Employee Participation in Fire Departments Outside of Elk River <br />Employees who serve as firefighters outside of the City of Elk River must notify their <br />immediate City of Elk River supervisor as soon as possible when they are tardy/delayed for <br />their normal scheduled work shift due to an emergency call. If advance notice is not <br />possible (e.g., emergency calls received while en route to work), the employee should <br />contact their supervisor as soon as reasonably possible. <br />The employee must provide written documentation (run report, log, etc.) from their <br />department confirming participation in the emergency call or scene (fire, rescue, or <br />medical) as soon as it is available or before the submittal of their timecard whichever <br />comes first. <br />At the discretion of the supervisor, the employee may be provided the opportunity to <br />make up the time missed within the same workday. If this cannot be accommodated, the <br />employee must use accrued vacation or compensatory time for the missed hours. <br />Supervisors are responsible for ensuring that all time adoustments are accurately <br />recorded. Employees will not receive additional pay from the City of Elk River for time <br />spent responding to said emergencies. <br />All non-exempt. non -Elk River volunteer firefighters must turn their pagers off during their <br />regular scheduled shift while working for the City of Elk River so as not to cause a <br />distraction for themselves and others in the workplace. <br />This guideline _may _be modified by the City of Elk River at_anvnoint in time. <br />Employee Participation in the Police Reserves <br />City employees who are also member of the Elk River Police Reserves and are paid for <br />their work as a Reserve Officer shall be paid overtime at the Reserve rate when Reserve <br />work contributes to the FLSA requirement for overtime compensation. <br />Regular position hours worked as overtime shall be paid at the regular overtime rate. <br />Political Activity <br />Employees may belong to a political party and are entitled to complete freedom from all <br />Page 54187 <br />Page 125 of 447 <br />
