Prior to releasing the Final Plat for recording, the Developer shall convey Outlots A, C , and O <br />to the City by warranty deed, free and clear of any and all encumbrances. <br />C. The developer shall convey Outlots B, D, and P by warranty deed, free and clear of any and <br />all encumbrances, to the HOA upon establishment. <br />D. The developer shall convey Outlots containing stormwater ponds (outlots J, M, and T) with <br />future development additions, and after the public improvements conveying stormwater to <br />these facilities are secured with future sureties. <br />E. The developer shall establish a Homeowners Association (HOA) to manage the maintenance <br />of all common areas within the development. <br />F. The Developer shall coordinate the relocation or modification of overhead power lines and <br />poles with Elk River Municipal Utilities (ERMU). <br />G. All requirements of the agreement to reimburse development-related costs entered into <br />between the City and Developer regarding the improvements to the intersection of Highway <br />10 and 165th Ave NW remain in effect. This contract does not replace any requirements or <br />agreements described in city agreement 2025-16. <br />H. The Developer shall install a temporary turnaround at the ends of Ulysses, Vance, and Yale <br />Streets until they are extended with subsequent phases of the Oakwater Ridge <br />development. The temporary turnarounds must be paved and signed “FUTURE STREET <br />EXTENSION” within one year of construction unless the roadway is extended. Before the <br />City signs the final plat, the Developer shall furnish the City an appropriately executed public <br />temporary turnaround easement, in recordable form. <br />I. Prior to releasing the Final Plat for recording, the Developer shall furnish a boundary survey <br />of the proposed property to be platted with all property corner monumentation in place and <br />Page 80 of 379
